DeHeng Successfully Represented Client in Complex Bankruptcy-Related Litigation, Dismissing Opponent Hundreds of Millions in Claims

Recently, DeHeng successfully represented a restructured listed company in a bankruptcy-related litigation case against a financial institution creditor in a High People’s Court, resulting in the dismissal of the opponent’s claims and saving the client hundreds of millions in potential losses.
In this case, our client was formerly a main board-listed company that underwent bankruptcy restructuring and successfully introduced restructuring investors to achieve revival. A financial institution creditor, following so-called “operational practices” during the restructuring process, encountered procedural issues that led to unfavorable outcomes where debt repayment conflicted with the restructuring plan. After receiving the mandate, DeHeng, facing dense factual details, complex procedures, and intricate legal relationships, conducted a comprehensive analysis from multiple dimensions, including the Enterprise Bankruptcy Law, the Civil Code, and regulatory provisions on listed companies, and achieved an ideal result: both the first-instance ruling by the intermediate court and the second-instance ruling by the high court dismissed all claims of the opposing party.
