DeHeng Won a Construction Dispute Case for a Central SOE, Dismissing All Claims Totaling RMB 250 Million

Recently, DeHeng successfully represented a client in a typical construction dispute case involving “black and white contracts.” Over four years, lawyers Zhang Junhai and Zhang Yufen thoroughly argued before the court on multiple key issues: the validity and actual performance of the “black and white contracts”; whether the “black contract” and two “white contracts” constituted counterclaims; the handling and application of preparatory joinder of claims and inconsistencies between the parties’ assertions and the court’s characterization of the legal relationship; and whether the court’s refusal to allow the plaintiff to withdraw the lawsuit was correct and appealable. They fully demonstrated that the prerequisite for applying the filed contract was its legal validity, submitted substantial evidence of actual performance, and identified and challenged forged and altered evidence discovered during litigation, proving that the “black contract”—executed under collusive sham arrangements—reflected the true intent of both parties and was actually performed. Although litigation costs and appraisal fees exceeded RMB 7 million, the court ultimately dismissed all of the plaintiff’s claims totaling RMB 250 million in accordance with the law.
