DeHeng Successfully Represented Client in Loan Contract Dispute, Avoiding Losses Exceeding RMB 100 Million

Recently, a loan contract dispute case with an amount involved exceeding RMB 100 million, represented by partner Tian Runsu from DeHeng’s Beijing Office, achieved a complete victory after proceedings in the first instance, second instance, and retrial application. The case received favorable rulings in both the first and second instances, with all appeal requests being dismissed by the Shenzhen Intermediate People’s Court. Subsequently, the Guangdong Provincial High People’s Court also ruled to reject the application for retrial, and the Guangdong Provincial People’s Procuratorate did not support the protest, bringing the case to a successful conclusion.
The litigation process was challenging. The plaintiff claimed that a RMB 50 million payment made to the defendant through a third-party company in 2016 constituted a loan and initiated legal proceedings accordingly. Despite surface-level adverse factors such as the defendant’s signature on the “IOU” and the transfer note stating “investment funds,” DeHeng lawyers, upon accepting the mandate, leveraged precise case analysis and professional litigation strategies, turned the situation around, and secured victories at every stage, from the first instance, second instance, to the retrial application.
