DeHeng’s Representation in “Lang Wei Xian” Account Enforcement Case Selected as Guiding Case by Supreme People’s Court

Recently, the Supreme People’s Court issued its 47th batch of Guiding Cases (Nos. 262-267), under the theme of judicial protection of data rights for the first time. The case of Cultural Media Co., Ltd. A v. You X Mei Enforcement Implementation Case (Guiding Case No. 267), represented by the DeHeng team led by lawyer Liu Jianzeng, a member of the Management Committee of DeHeng’s Chongqing Office, was selected. This case clarifies that “the enforcement and delivery of online platform accounts include the modification of real-name authentication information,” providing a breakthrough solution to the judicial dilemma of “easy determination of rights but difficult enforcement” for online platform accounts.
Case Summary
The ownership dispute between Cultural Media Co., Ltd. A and You X Mei over the “Lang Wei Xian” accounts on Douyin and Kuaishou were adjudicated in the first and second instances by the Chongqing No.1 Intermediate People’s Court and the Chongqing High People’s Court, respectively. The final judgment confirmed that the accounts belonged to the Cultural Media Company, and You X Mei was required to deliver the accounts and passwords within three days of the judgment taking effect.
However, enforcement of the favorable judgment faced difficulties, as the “Lang Wei Xian” accounts remained linked to You X Mei’s personal real-name information and mobile phone number. If the Cultural Media Company only received the passwords without changing the underlying identity information, it could lose control of the accounts at any time if You X Mei resets the passwords through identity verification, making the “paper rights” difficult to convert into actual rights.
Case Outcome
Through court enforcement, the real-name authentication information for the involved accounts was cleared, and the mobile phone numbers were re-linked. The Cultural Media Company obtained complete and exclusive control over the “Lang Wei Xian” accounts. All related costs in the case were fully enforced.
