DeHeng Successfully Reversed Complex Criminal-Civil Overlapping Case, Securing Critical Retrial Victory for Client

DeHeng’s Chengdu Office recently achieved another significant accomplishment. In a sales contract dispute case involving suspected criminal activity, the first and second-instance courts had dismissed the lawsuit and transferred the case to public security authorities for investigation. DeHeng’s Chengdu Office represented the client in applying to the Sichuan Provincial High People’s Court for a retrial. In the retrial, the arguments presented by DeHeng’s lawyers were adopted by the court, which revoked the original first and second-instance rulings and instructed the first-instance court to continue hearing the case.
Bulk commodity trade, due to its complex transaction structures and legal relationships, often involves parties in the chain being passively or actively implicated in criminal activities. In this case, the lawsuit was dismissed in both the first and second instances, as the original courts deemed the matter involved suspected criminal activity and should be transferred to public security authorities. After receiving the mandate, DeHeng’s lawyers accurately grasped its core issues, ultimately leading to the revocation of the original rulings.
