DeHeng Successfully Represented a Government Department in a Mass-Involved Criminal Judgment Execution Supervision Case at Tianjin High People’s Court

Recently, in a mass-involved criminal judgment execution supervision case accepted by the Tianjin Higher People’s Court, DeHeng represented a government department of a city in Shandong Province and prevented a local Tianjin court from executing actions against the government department based on the property-related content of its criminal judgment, marking the successful representation by DeHeng lawyers.


In December 2023, a local Tianjin court made a criminal judgment in a case involving the crime of illegal pooling of public savings and fundraising fraud, and listed a PPP project located in a city in Shandong as an involved fundraising project in an annex to the judgment. Based on this, the court, starting from July 2024, froze over RMB 1 billion of contract payments due to the government department under the PPP project contract and notified the government department to directly pay the above contract payments to the local Tianjin court for compensation to the victims of the aforementioned criminal case.


In September 2024, under the leadership of the city’s Political and Legal Affairs Commission and the municipal government, the government department in question urgently engaged DeHeng to represent it in the execution case. After accepting the mandate, DeHeng immediately formed a team of backbone lawyers with rich experience in PPP projects, criminal-civil crossover, execution, and bankruptcy, actively responded, and quickly sorted out the basic facts and legal relationships of the case, especially the detailed financial transactions under the involved PPP project contract. After clarifying the sources and destinations of the funds of the involved PPP project, the DeHeng lawyers determined that they were unrelated to the funds involved in the criminal acts of the aforementioned criminal case.
