In a financial loan contract dispute case, the actual borrower used a shell company to defraud a financial institution of a loan. The financial institution did not conduct the necessary due diligence. Subsequently, when the shell company failed to repay the loan, the financial institution brought the case to court, demanding repayment from the shell company and all guarantors. Both the first-instance and second-instance courts ruled that the loan contract was legally valid and supported all of the financial institution’s claims.
In the second-instance trial, lawyer Kang explained the criminal facts of the case in a defense opinion, but this was not accepted by the court. Subsequently, lawyer Kang advised the client to switch directions and file a criminal complaint, which was accepted. This directly led to the retrial reversal, and the client finally achieved the desired outcome.
