Case Handled by DeHeng Lawyer Selected for the Summary of Judgements of the SPC Intellectual Property Court (2024)

On April 25, 2025, to mark the upcoming 25th World Intellectual Property Day, the Supreme People’s Court (SPC) released the “Summary of Judgements of the SPC Intellectual Property Court (2024).” The case involving an administrative dispute over the invalidation of a utility model patent for a “telescopic elevator car” (2023) handled by lawyer Wang Rui from DeHeng’s Beijing Office was selected.

In this case, lawyer Wang helped the client achieve a successful reversal in the second-instance trial at the SPC. The court overturned the invalidation decision by the National Intellectual Property Administration and the first-instance judgment by the Beijing Intellectual Property Court, and ordered the National Intellectual Property Administration to make a new invalidation decision. Achieving such a result is rare, as the SPC rarely overturns both the National Intellectual Property Administration and the first-instance judgment simultaneously. The case involved the assessment of technical inspiration, especially the determination of whether technological personnel in the field have the motivation to improve existing technologies.
