DeHeng Successfully Represented Client in Major Intersecting Criminal and Civil Case Involving Corporate Interest Infringement, Exempting Over RMB 36 Million in Compensation Liability

Recently, the Shanghai High People’s Court ruled on a case involving a well-known international freight company (hereinafter referred to as “Company D”) and its former senior executive (the “client”), rejecting Company D’s retrial application. This marked the end of a three-year-long legal battle, with the client achieving a comprehensive victory. The case (during the second instance and retrial review stages) was handled by partner Zhang Lu and his project team from DeHeng’s Shanghai Office (“DeHeng lawyers”).
In 2024, the Shanghai Second Intermediate People’s Court issued a final civil judgment, determining that the alleged tortious acts and damages claimed by Company D were not established. The court ruled that the compensation claims made by Company D lacked factual and legal basis and should not be supported. The judgment overturned the first-instance civil judgment from a Shanghai district court, dismissed all of Company D’s claims, and ordered Company D to bear the first-instance case acceptance fees, preservation fees, and second-instance case acceptance fees.
