DeHeng Hangzhou Successfully Represented Popular Streamer in Early Termination Contract Dispute Case

Recently, DeHeng Hangzhou Office’s E-commerce and Internet Celebrity Economy Practice Group successfully represented a popular streamer with over five million followers in a contract dispute case involving early termination with a Multi-Channel Network (MCN) company. After accepting the mandate, DeHeng’s Hangzhou Office formed a professional project team led by Zhu Jianwen, the head of the E-commerce and Internet Celebrity Economy Practice Group, with support from He Xinran, Secretary-General of the Group, and He Feiyan, a Group member. They conducted meticulous legal work for this case.
First, they comprehensively reviewed the contract in question, clarified the details of the cooperation between both parties and provided textual and systemic interpretations of the contract that favored the streamer. Second, they calculated the training costs that the MCN company had invested in the streamer, proving that the MCN company’s investment in the contract in question was significantly inconsistent with the losses it claimed. Third, based on the income of both the MCN company and the streamer during the performance of the contract, they assessed the MCN company’s cost recovery situation and reduced the expectation of potential profit losses due to the streamer’s early termination. Fourth, they maintained close communication with the streamer and thoroughly reviewed the performance matters of both parties.
Ultimately, the court only supported 30% of the liquidated damages claimed by the MCN company as stipulated in the contract.
