DeHeng Successfully Represented an Insurance Company in an Insurance Subrogation Arbitration Case and Recovered a Huge Compensation

Recently, DeHeng represented the insurer in an insurance subrogation case accepted by the China International Economic and Trade Arbitration Commission (CIETAC). Despite unfavorable outcomes in similar cases, DeHeng successfully helped the client (hereinafter referred to as the “Principal”) achieve a significant victory in the arbitration. The tribunal supported the vast majority of the arbitration claims, as well as the arbitration fees and legal costs, thereby safeguarding the Principal’s lawful rights and interests. The arbitration representation by DeHeng lawyers was a resounding success.
This case involved multiple parties, including a foreign one, with complex legal relationships. It covered intricate legal documents such as insurance contracts and transportation agreements. One of the key issues was identifying the responsible party for the insurance accident. After reviewing the case, the arbitral tribunal determined that the damage to the engine during transportation was clear. The Principal had paid the insurance claim to the insured as per the agreement and had lawfully obtained the right of subrogation. As per the provisions of the General Agreement on Transportation Services, the respondent was liable for the corresponding compensation. Ultimately, the tribunal supported the vast majority of the applicant’s arbitration claims, arbitration fees, and legal costs.
