DeHeng Successfully Represented Cross-Border Enforcement of Mainland Civil and Commercial Judgment in Hong Kong

Recently, DeHeng received an order from the Hong Kong High Court approving the registration of a civil and commercial judgment from the Chinese mainland. The amount in question exceeds RMB 100 million. In this case, DeHeng’s Shanghai Office dispute resolution team took the lead and worked closely with lawyers in Hong Kong, laying a solid foundation for the cross-border enforcement of the judgment.

The mainland judgment in question involved a significant and complex "Belt and Road" investment contract dispute, in which DeHeng lawyers successfully represented the client. After a first-instance judgment by a local intermediate people’s court and a second-instance judgment by a higher people’s court in western China, the client won the case. However, during the litigation, the defendant transferred substantial assets to Hong Kong, which led to difficulties in enforcing the mainland judgment and significant harm to the client’s interests.

Once the mainland judgment is served, it will be enforceable in Hong Kong, enabling the client to pursue cross-border enforcement against the defendant using the obtained asset information. This outcome has been highly praised by the client.
