DeHeng Assisted Xinyi Solar in Winning India’s Antidumping Sunset Review Investigation

On September 19, 2023, at the request of Borosil Renewables Limited, India’s Ministry of Commerce and Industry initiated an antidumping sunset review investigation on photovoltaic glass originating in or imported from Malaysia. Xinyi Solar Holdings Co., Ltd. – Xinyi Solar (Malaysia) once again mandated DeHeng Law Offices to assist it in responding to the lawsuit. On November 29, 2023, the Ministry of Commerce and Industry of India announced the final ruling, finding that the export price of Xinyi Solar (Malaysia) was higher than the normal value, and there was no dumping or dumping possibility, so it recommended that the antidumping duties should not be imposed on the products involved any more. The case was officially concluded.


This antidumping original investigation was initiated in February 2018, and after nearly a year of hard work, DeHeng assisted Xinyi Solar in obtaining a zero duty rate, while other Malaysian exporters were ruled to be subjected to an antidumping duty of USD 114.58/tonne. In June 2021, the Ministry of Commerce and Industry of India initiated an antidumping sunset review investigation on China’s photovoltaic glass, and in 2022 ruled to continue to levy the antidumping duty. DeHeng appealed to the Ministry of Finance of India on behalf of Xinyi Solar, requesting that the tax proposal of the Ministry of Commerce and Industry be rejected, which was finally supported by the Ministry of Finance. The case was closed without the imposing of tax.
