DeHeng Lawyer Contributed to the Successful Completion of China's International Project as a DAB Adjudicator

The Owner has issued the Take Over Certificate of electricity power project in Kandaand Legon Region in Ghana, West Africa, to its Chinese EPC Contractor recently. Mr. Huai Yuan Jia, the senior partner of DeHeng Law Offices and managing partner of DeHeng Dubai office, was appointed an Adjudicator of the DAB by the Chinese EPC Contractor, along with presiding Adjudicator from London and another Adjudicator appointed by Ghana government, respectively, upon the commencement of the Project. The DAB has successfully fulfilled all its expected works by solving issues during the execution of the Contract in cooperation with the Owner, Engineers and Contractor. 

This Project is funded by the US government's Millennium Challenge Corporation to assist the Ghanaian government to promote economic growth and reduce poverty, with a total investment of USD 498.2 million. After the US side agreed with the constitution of the DAB by reviewing the qualifications, experience, and achievements of the three DAB adjudicators, Mr. Jia, together with the other two DAB members, held several meetings with the Owner, Engineers and the Contractor to solve issues arising from the execution of the Contract, particularly issues in relation with the Covid, e.g EOT and special Covid tax levied by Ghana government. When the Contractor raised these concerns, the DAB discussed with the Owner and the latter promised to grant EOT and refund the tax levied to the Contractor. Shortly after the meeting held by the DAB, all concerns were settled completely without any delay.

With the support, supervision and coordination of DAB members, all concerns and issues, including potential ones, by both the Employer and the Contractor as well as the Engineer in relation to the Project have been satisfactorily resolved in a timely manner. 

DAB played an irreplaceable role in ensuring the successful completion of the Project. Its success again proves that DAB is capable of, in the implementation of international projects, timely and promptly settling international project disputes, and avoid further international project arbitration to the utmost extent.
