The Procuratorial Organ Dropped All Three Charges

against a Client of DeHeng

The procuratorial organ recently made the decision not to prosecute the case against our client surnamed Hu for the crimes of extortion, destroying the computer information system and concealing accounting vouchers, financial books and financial accounting reports. 


Hu used to be the financial director of a company, and was fired due to grievance with the company's chairman over personal equity transfer. The public security authorities accused Hu of extorting RMB 1.5 million from the company by threatening not to return the company's financial books after he was fired, and of privately modifying the company's financial software data and deleting software, thus causing great economic losses to the company, etc.


This was typical parallel civil-criminal proceedings. After the procuratorial organ approved the arrest of Hu, his family dismissed the former lawyer, and after initial communication, formally hired DeHeng lawyers to act as Hu's defender.


After accepting the mandate, lawyer Guan Zhenhai led his team composed of lawyers Tian Kun and Ma Wenjing to discuss the case several times and properly divide the work. After many meetings, they carefully examined the existing evidence, investigated and collected more evidence, applied for review of custody necessity, and communicated with the case handlers and victims. In the end, the procuratorial organ adopted their defense opinion that Hu's behavior did not constitute a crime.
