DeHeng Successfully Represented China's Third

and Zhejiang's First Case to Recognize and Enforce US Court Judgment

2020-12-30

A client surnamed Wen represented by DeHeng lawyers filed an application to the Intermediate People's Court of Ningbo, Zhejiang Province (hereinafter referred to as "the Court"), for recognition and enforcement of the civil judgment made by the U.S. Superior Court of Stanislaus County, California, and won the approval of the Court.

The case was represented by Managing Partner Huang Jianing and Lawyer Xu Meiqian from DeHeng's Hangzhou Office and last for two years from December 2018. The core working language was English. The DeHeng lawyers made in-depth interpretation of US law and Chinese law, and provided comprehensive and efficient professional legal services to the client.

This is China's third* and Zhejiang's first case to  recognize and enforce U.S. court's judgment based on the principle of reciprocity. It consolidates the basis for promoting mutual respect for judicial sovereignty and provision of judicial reciprocity between China and the United States, and is a typical case for reference.

*Note: The first case in which a Chinese court recognizes and enforces a judgment of a US court currently available through public channels is ruled by Wuhan Intermediate People's Court in Year 2017 in the case of (2015) Hubei Wuhan Zhongmin Shangwai Chuzi No. 00026, which recognizes and enforces the United States Judgment No. EC062608 of the Superior Court of Los Angeles County, California; The second case is ruled by the Shanghai No. 1 Intermediate People's Court in Year 2017 in the case of Shanghai 01 Xiewairen No. 16, which recognizes and enforces the judgment of the Federal District Court for the Northern District of Illinois.
